This Agreement sets forth the legally binding terms and conditions for your use of the Site at http://www.portier.com.au

By accessing or using the Site in any manner, including, but not limited to, visiting, or browsing the Site or contributing content or other materials to the Site, you agree to be bound by these Terms and Conditions. Capitalised terms are defined in this Agreement.

Intellectual Property

The Site and its original content, features and functionality are owned by portier Australia Pty Ltd and are protected by international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.

Termination

We may terminate your access to the Site, without cause or notice, which may result in the forfeiture and destruction of all information associated with you. All provisions of this Agreement that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Links To Other Sites

Our Site may contain links to third-party sites that are not owned or controlled by portier Australia Pty Ltd.

portier Australia Pty Ltd has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party sites or services. We strongly advise you to read the terms and conditions and privacy policy of any third-party site that you visit.

Governing Law

This Agreement (and any further rules, policies, or guidelines incorporated by reference) shall be governed and construed in accordance with the laws of Victoria, Australia, without giving effect to any principles of conflicts of law.

Changes To This Agreement

We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions by posting the updated terms on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms and Conditions.

Please review this Agreement periodically for changes. If you do not agree to any of this Agreement or any changes to this Agreement, do not use, access, or continue to access the Site or discontinue any use of the Site immediately.

Gift Cards and Credit Notes

Gift Cards & Credit Notes are valid for 3 years from date of purchase.
Gift Cards & Credit Notes can be redeemed against all currently available products on the Site excluding products on pre-order.
Gift Cards & Credit Notes are non-transferable, can only be used on the Site.
Gift Cards & Credit Notes may not be returned or redeemed for cash.
If your order total is less than the value of the Gift Card or Credit Note, the remaining balance will be available and can be redeemed against subsequent orders.
All remaining balances exceeding the value of your gift credit or store credit must be paid via an alternate payment method.
If you return products you have purchased using a Gift Card, the remaining balance will be credited to you as store credit and can be redeemed against subsequent orders.
Virtual Gift Cards will be e-mailed to the purchaser once the full order has been processed and payment has been taken.
portier is not liable for delivery of a Virtual Gift Card or Credit Note to an incorrect or non-existent email address. This is the sole responsibility of the purchaser.
portier is not responsible if a Gift Card is lost, stolen, destroyed or used without permission.
portier reserves the right to cancel a Gift Card or Credit Note if we deem such action necessary.
You cannot use any discount codes to purchase a Gift Card.

Promotional Codes

All promotion codes are non-transferable and there is no cash alternative. No more than one promotional code can be applied at checkout or to an order. They cannot be used in conjunction with any other promotion code or offers, and must be redeemed by the date published, if provided. portier reserves the rights to cancel or refuse the usage of any promotional code at any time.

All promotional codes must be applied at checkout, and cannot be applied to any previous or retrospective orders or gift card purchases. We have the right to refuse use of any promotional code for any reason. The times of use will be outlined in the marketing material, the code cannot be used outside of this time.

Specific Promotions and Competitions 2025

From time to time, portier may run promotions or competitions on our Site or Social Media which are subject to both these Terms and any additional promotion-specific / competition-specific terms which are incorporated into these Terms by reference.

Promotions and competitions are open to global residents, over the age of 18 years.

Promotion-specific and competition-specific terms may include conditions in respect of selected styles, brands, colours, collections, purchase periods, purchase methods, minimum spend requirements, bundle discounts, partner promotions, conditions of entry, games of chance or games of skill.

You should ensure that you read the specific conditions that apply to each promotion or competition. By proceeding to purchase you agree and accept the terms of the applicable promotion(s)/competition(s).

We also undertake joint promotions/competitions with third party partners from time to time. You should consult the terms of those programs for full details of such specific joint promotion/competition.

In entering our promotions or competitions you release Instagram from all responsibility and agree to Instagram’s Terms of Service.

Monthly Social Database Competition

The promoter of this competition is portier Australia ("the Promoter").
The competition runs on a monthly basis, with each entry period beginning at 12:00 AM (AEST) on the first day of the month and closing at 11:59 PM (AEST) on the last day of the month ("Competition Period").
Entry into the competition is automatic for individuals who subscribe to the portier Australia newsletter during the Competition Period.
Each new subscriber is entitled to one (1) entry per Competition Period.
Unsubscribing before the draw will disqualify eligibility.
The prize for each monthly draw is one (1) portier Limitless Baby Carrier ("Prize") of the winner's choice, subject to availability.
The Prize is not transferable, exchangeable, or redeemable for cash or any other alternative.
The winner will be drawn at random on the last day of each month (or the next business day if it falls on a weekend or public holiday).
The winner will be notified via the email address provided during subscription within three (3) business days of the draw.
If the winner does not respond within five (5) business days of notification, a new winner may be selected at the Promoter’s discretion.
By entering this competition, participants agree to these Terms & Conditions.
The Promoter reserves the right to verify the validity of entries and disqualify any entrant who tampers with the entry process.
The Promoter is not responsible for any incorrect or inaccurate information supplied by entrants or for any lost, late, or misdirected entries.
The Promoter reserves the right to modify, suspend, or terminate the competition at their discretion.
By entering, participants consent to the collection and use of their personal information by the Promoter for marketing and promotional purposes.

Competition:

Terms and conditions apply. Competition open to One Fine Baby Melbourne Expo visitors over 16 years of age. Entries will be deemed valid upon successful completion of the competition entry form. Competition commences at 9am AEST Saturday Sept 20, 2025 and closes at 4pm Sunday Sept 21, 2025 AEST. Entrants consent to subscribing and receiving marketing material from portier upon form submission. The Prize is not transferable, exchangeable, or redeemable for cash or any other alternative. Prize pool as outlined on the entry page is value at $1,000 AUD. The winner will be drawn at random on Monday Sept 22, 2025 and emailed directly. By entering this competition, participants agree to these Terms & Conditions. portier is not responsible for any incorrect or inaccurate information supplied by entrants or for any lost, late, or misdirected entries.

Product Specifications

Although we endeavour to provide accurate and complete information on the Products and Services listed or advertised on the Site, we cannot guarantee that the information is up to date, accurate and complete always. We reserve the right to (but are not obligated to) make changes or updates to information displayed on the Site at any time without notice to you. We have made every effort to display as accurately as possible the colours and images of our Products that appear at the store. We cannot guarantee that your computer monitor's display of any colour will be accurate. Unless otherwise stated, any accessories, decorations or furnishings shown in images of Products or Services on the Site are not included.

Orders

You may place an Order by completing the Order form on the Site and clicking the "confirm" button. Orders are subject to the availability of Products and/or Services requested in the Order. An Order is not accepted and legally binding on us until we confirm by email (to the email address nominated at the time of Order or as listed in your Account) that:

payment has been received for the Order.
the Products and/or Services are available; and
the Order has been processed.

To the maximum extent permitted by law, Orders may not be cancelled by you once they have been accepted by us. We operate an online business, and we will communicate with Customers or visitors to our Site who make an enquiry primarily via email. It is the Customer’s responsibility to therefore ensure that the correct contact details are provided and that the nominated email address is regularly checked for correspondence. Each Order (once confirmed by us in writing) represents a separate agreement between the parties (and each separate Order placed by you on, or via, the Site will be subject to this Agreement). If an Order has been cancelled, refused, or cannot be met due to unavailability of Products and/or Services, we may attempt to notify you by contacting you on any of the contact details provided at the time you placed the Order. Funds paid in relation to that Order will be refunded in full as soon as is reasonably practicable. You will be provided with email acknowledgement of the cancellation and refund. We accept no responsibility for Orders that are declined, misplaced, not received, or not accepted due to disruptions caused to our internet connections or our computer systems. Where you have provided an incorrect or incomplete delivery address for your Order and your Order is returned to us, we may redeliver the Order at your request and charge a redelivery fee for each subsequent delivery attempt. We do not guarantee the availability of any Products or Services displayed or ordered on, or via, the Site.

Payment

You can pay for your Order using any of the methods specified on the Site. A surcharge may apply to payments made by credit card depending on the credit card used. You agree and acknowledge that we will treat an electronic instruction as authentic and are under no obligation to investigate the authenticity or authority of persons issuing or transmitting such electronic instructions, or to verify the accuracy and completeness of such electronic instructions. If your nominated payment method triggers our internal suspect transaction protocols, we may contact you to confirm additional details, or rescind the transaction. In this case, until your Order has passed our fraud prevention protocols your Order will not be fulfilled. If you do not provide the requested information within 7 days, your Order will be cancelled, and your payment will be refunded back to you via the method in which you paid. These information requests are sent to help protect credit card holders from online fraud though we provide no guarantee that we will identify any or all instances of online fraud that may occur in relation to any Order made on or via the Site.

Delivery and Ownership of Products

We will use reasonable endeavours to ensure that all Products or Services are delivered in a prompt and timely manner. However, delivery dates are estimates only and factors outside our control may result in delays to delivery. The estimated date of delivery may change without notice. We do not accept any liability for loss or damage suffered by you or anyone because of any such delays. We will not deliver Products to PO Box addresses or post restante addresses. We reserve the right to refuse shipping to remote or rural locations.

Orders must be paid in full before delivery can be made. You acknowledge and agree that it is your responsibility to ensure that you have nominated the correct delivery address and provided sufficient and appropriate details to identify the recipient in making an Order, and we are not responsible for any misplaced parcels or for delivery of any Order to an unintended recipient because of incorrect details. You must ensure that any person who collects or takes delivery of the Products on your behalf is authorised by you to do so. Title and risk in the Products pass to the Customer on signing for delivery of the Products. Where a customer gives written authority for Products to be delivered without a signature:

all included insurance cover (if any) will be voided; and
title and risk in the Products pass to the Customer on delivery of the Products to your nominated delivery address.

The nominated courier will deliver the Products on a Business Day. We are not responsible for the delivery times of Products. Once Products have been dispatched, it is the Customer's responsibility to liaise with our nominated courier company in relation to date of delivery and to make themselves available to take delivery at the nominated time for delivery. Any information provided by us to a customer in relation to the method of delivery and estimated delivery time will be from a third party, and as such we do not guarantee the accuracy or currency of such information. Delivery Costs may be subject to change without notice.

We are committed to protecting your privacy and personal information. Please see our Privacy Policy for further details about our practices relating to the collection, use, disclosure, and storage of your personal information.

Complimentary "MOTHER" Cap Promotion

The Complimentary "Mother" Cap promotion is available on all orders of $200 or more.

Customers who spend $200 or more will receive a complimentary "Mother" cap. The cap will be automatically added to all eligible orders at the time of purchase and does not need to be selected or redeemed by the customer.

The gift is non-transferable and cannot be exchanged, redeemed for cash, or applied as a discount to any purchase. If an order that qualified for the promotion qualifies for a return, all items included in the promotion must also be returned in accordance with our standard returns policy.

This promotion cannot be used in conjunction with any other promotion, discount, or offer. No rain checks will be provided. The promotion is limited to one complimentary cap per qualifying order, unless otherwise stated.

Refunds or exchanges will not be provided for change of mind; however, your rights under applicable consumer law remain unaffected, including in cases of faulty goods.
